News and Analysis on the 2025 Legislative Session

NEWS. December 10, 2024, in Little Rock.
The 2025 legislative session kicks off next month. However, bills are already being filed. Yesterday, a bill was filed by Representatives Unger and Lundstrum to make it a crime to give advance notice of a government inspection.
Under the bill, any notice to an entity subject to an inspection by any city, county, or state body can only be “the official notice regularly provided to all persons before an inspection.”
However, the sponsors are serious about the notices. Giving special notice to any entity up for inspection will cause the notice-giver to be terminated from employment and deemed malfeasance in office.
______
ANALYSIS. This is a poorly drafted bill. The prohibited conduct is “advance notice of an inspection that is outside of the notice regularly provided to all persons before an inspection.”
This begs the question. What is notice regularly provided? If, say, the code inspector always calls a jobsite before his arrival to let them know he is coming to inspect, is that “outside of the notice regularly provided?” Seems like the inspector regularly calls before an inspection, so this law does nothing.
HB 1058 is an example of over regulation by the government. It does not align with conservative political values and should die a quick death. The sponsors could save face by pulling the bill or amending it to address the real problem they are trying to solve.
