If you thought you were getting a Governor like President Trump when you voted for Sara Sanders well….you were wrong.
House Bill 1204 was filed on January 22nd by a host of the usual Swamp Creatures in the Legislature led by Senator Missy Irvin and Representative Jon Eubanks.
On its surface it was designed to con you into believing it will benefit the citizens of Arkansas by cutting back on frivolous lawsuits when in reality, it puts money in the pockets of out-of-state insurance companies and does nothing for you except deny you damages if you are injured at no fault to you.

It cleared the House last week and the Senate yesterday by one vote.
Here are the totals with the Senators and Representatives voting Yea highlighted in Green…..Appropriate color for Swamp Creatures.
The Bill was presented in the House and Senate Committees by Irvin, Eubanks and Lobbyist attorney Justin Allen from Wright, Lindsey & Jennings Law Firm.
While Irvin and Eubanks didn’t have much to say in testimony, Allen carried the water for Big Insurance companies as if he were in court defending a client.
When Allen, Irvin and Eubanks were asked if the Bill benefited insurance companies, they had no choice but to admit that it does.
When asked on multiple occasions if the Bill benefits Arkansans, they moved like slippery snakes in swamp water.
The only answer they could come up with is that our premiums are going to continue to go up but maybe….maybe….our premiums won’t go up as much if this Bill goes into law.
Translation – Out-of-State insurance companies get money in their pockets….You get zero and if you are, God forbid, injured at no fault to you….prepare to be screwed by an Elephant.
In spite of many passionate pleas on the House and Senate floors from Conservatives such as Representative Jimmy Gazaway, Senators Allen Clark & Clint Penzo, who called this Bill the “Insurance Enrichment Program”, the Swamp Creatures would not budge in their quest to put big corporate profits over people.
The Purple Party of Arkansas is so pleased with this outcome that they released a statement today with quotes from some of its most loyal Swamp Creatures like Joseph Wood, Bart Hester and Eddie Arnold.
The PPA statement sounds like a Rapist trying to convince their victim that they are actually making love.
While the swamp creatures celebrate, Conservative law makers and Citizens have been left numb wondering how their State, which is so Red, can have a Governor and Legislature that is so Purple ?
The reality is we no longer have the Republican Party of Arkansas….We have the Purple Party of Arkansas led by the Queen of the Swamp.
So now HB1204 sits on Governor Sanders desk waiting for her signature which will expand her Swamp that she rules over.
The only question left is will she wear a Green or Purple dress ?….Either will be appropriate.

This bill simply limits the recovery of medical expenses to those that were actually incurred.
In a hypothetical auto accident the hospital bills me $100k.
My Health Insurance Pays the agreed rate of $20k to the hospital on my behalf.
I pay the $5k in deductible.
The hospital considers the bill paid in full.
Before this bill a lawyer could sue the at fault party for the $100k
After this bill the lawyer is limited to the $25k of actually incurred medical expenses.
The bill does NOT effect any other type of compensatory or punitive damages.
How does this do anything other than balance the scales of justice by preventing a lawyer from trying to get paid for an imaginary medical expense bill that was never, and never will be, paid by anyone.
How does this enrich the insurance company?
the extra money isnt for the hospital its for the victums pain and suffering. do you think that the actuall exspense of being injured is all covered by hospital bills and not all of the other related thing.
The pain and suffering column is covered up here and should be fully exposed. Paying for broken bones is one thing but paying for the pain and suffering is part and parcel of the accident. Who pays for pain and suffering? And how do the courts deal with that in normal cases? Having the responsible parties’ insurance pay for pain and suffering is appropriate. The process should be streamlined and judges should use common sense in making awards. No one should be able to get a broken bone and hit the lottery because of a judge that is clearly out to lunch. But common everyday people should be able to get justice quickly and within a standard, transparent process.
