The Purple Party of Arkansas’s DEI Bill….As Clint Lancaster Would Say “A Toothless Tiger.”

On November 20^th Senate Bill 3, (SB3), was filed by Jonesboro’s Purple Party State Senator Dan Sullivan….Link for SB3

Before we can put SB3 in proper context, we have to realize reality.

There are three Parties in our State – The Party of Blue…The Party of Red…The Party of Purple.

The Good Reality – As to our State’s population, the Party of Red clearly makes up the Majority, with the Parties of Blue and Purple making up the Minority.

The Bad Reality – As to our State Capitol and State Legislature’s makeup, the Party of Purple makes up the clear Majority while the Parties of Blue and Red make up the Minority….I never said Reality makes sense.

The purpose of Sullivan’s SB3 is to end Diversity, Equity and Inclusion (DEI) laws in our State, but is that Reality ?….Or is SB3 intended to fool you into believing no more DEI ?

It starts out sounding good with its Title –

AN ACT TO PROHIBIT DISCRIMINATION OR PREFERENTIAL TREATMENT BY THE STATE OF ARKANSAS AND OTHER PUBLIC ENTITIES; AND FOR OTHER PURPOSES.

Titles are often misleading though….Remember THE AFFORDABLE CARE ACT ???

That leads us right into Section 1 of SB3 “Legislative Intent” which states –

DO NOT CODIFY. Legislative intent. (a) The General Assembly intends for this act to prohibit discrimination by public entities on the basis of race, sex, color, ethnicity, or national origin. (b) The General Assembly does not intend for this act to affect any preferences provided to veterans under the law based on their status as a veteran.

While the Intent sounds great, did you see the Catch ?….DO NOT CODIFY.

Codify means to put into Code…Statute…Law.

Do Not Codify defined means – to not arrange or systematize something into formal written code, essentially leaving it without a clear, structured set of rules or guidelines.”

In other words, it is not Law.

Sullivan is saying to you – This is the intent of my Bill….But that’s not Really its intent.

SB3 in Sections 2 – 22 goes on to do what looks like a good job of striking and repealing bad law, along with codifying new good language into law in order to eliminate DEI in our Government –

Title 3 Alcoholic Beverage Control

Title 6 Education

Title 16 Practice, Procedure and Courts

Title 21 Public Officers & Employees

Title 22 Public Property

and

Title 25 State Government

I said “Looks like a good job of” for a reason.

In only one of the Title Sections included in SB3 is there a penalty for violation and that is in Title 25 Section 21….A Class A Misdemeanor….Good luck finding a Prosecutor who will actually prosecute someone for that violation.

The Legislature is famous for enacting laws that pertain to Government Agencies and Officials that, if broken, have no penalties.

Let’s use speeding as an analogy – You get a speeding ticket and then go before the Judge who asks, “How do you plead ?”….You reply, “Guilty Your Honor.”….The Judge then says “That will be a Zero Dollar fine. Go have a nice day and speed all the Hell you want.”

Does that make any sense ?….Of course it doesn’t but then again, we are talking about the State Legislature, formerly controlled by the Party of Blue and now controlled by the Party of Purple.

SB3 finishes up with Section 23 which spells out reporting obligations of State Agencies to the Legislative Council on implementation and compliance with SB3.

The language in Section 23 sounds like the Legislative Council means business in its oversight of compliance, right ?

The problem again is those three little words Section 23 starts with – DO….NOT….CODIFY.

That renders it as useless as breasts on a boar hog….I’d rather say that another way, but Jennifer would not approve….She’s funny like that.

SB3 is much like the Indoctrination and Critical Race Theory Laws in the Learns Act….Tough talk with no accountability, so Indoctrination continues on a daily basis in our Schools.

For the last 15 years the Party of Purple has been feeding the Party of Red soy burgers to the point many of them believe they are eating actual hamburgers.

Well, this Ole Boy has not forgotten what hamburgers taste like and that soy burgers taste like S….Crap….I caught myself Jennifer.

Want some more Reality ?

Until the Party of Red shows up to the Capitol and demands a real DEI ending Bill and other real Conservative legislation then we are stuck with eating Purple Soy Burgers.

It’s past time for Conservatives in the Party of Red to get off their Butts and take back the Capitol Offices and control of the Legislature….Have we forgotten we ARE the Majority ?
