UPDATE – Fort Smith Northside Coach Felix Curry….District Violated State Law In Reassignment

Two days ago, we at Arkansas 1st News broke the story that Northside Head Football Coach Felix Curry had been terminated as Head Coach and is currently reassigned to monitoring In School Suspension.

My investigation into the matter has revealed some very strange and unsettling facts, one of which is the District violated State Law when Coach Curry was reassigned.

Wednesday, I sent FSSD Superintendent Terry Morawski a Freedom of Information request.

I asked for the directives to –

1. Terminate Coach Curry as Head Football Coach.

2. Reassign him.

3. Post the job listing for Head Football Coach.

Assistant Superintendent Chris Davis responded stating that they have no records responsive to my request….In what world does that make sense ?

According to Coach Curry’s attorney, Joey McCutchen, Curry was informed of his termination as Head Football Coach and reassigned by Northside High School Principal Chris Carter on December 4^th.

Now are we to believe that Carter took it upon himself to take this illegal action without a directive from the Superintendent or one of his Assistant Superintendents on his behalf ?…..Sorry that frog don’t hop.

Here’s a fun fact for ya….The Superintendent cannot reassign an employee…. only the School Board has the authority and power to do that.

AR Code 6-17-303 Assignment and Reassignment of teachers states – “School district boards of directors shall have authority to assign and reassign or transfer all teachers in schools within their jurisdiction upon the recommendation of the superintendent.”

The Superintendent can recommend the reassignment….but he does not have the authority or power to do it.

According to District School Board meeting records, Coach Curry being reassigned has not been on any meeting agendas and the Board has not taken any action to reassign him.

At this point I think it’s more than fair to say….What the Hell is going on in Morawski’s administration ???….Somebody is way out over their skis on this.

The next School Board meeting is Monday night so it will be interesting to see if any of this is on the Agenda.

McCutchen has informed me that he has requested to speak during the public comment section of the meeting. Allowing public comments at the meetings is at the Board’s discretion so they could vote not to allow them Monday night.

I hope they don’t take that action….If they do, it will be no different than flipping off the citizens ….Something that seems to be common in Fort Smith Government.

Right now I am working on a comparison between Coach Curry and Southside Head Football Coach Kim Dameron which I will have out in an article next week.

For now I’ll leave you with this….So far I really only see one difference between these two men and their programs….One.
