Felix Curry Files Lawsuit Against Fort Smith Schools Superintendent Terry Morawski For Illegally Removing Him As Head Coach

On December 11^th of last year, I brought you the story of Fort Smith Northside Head Football Coach Felix Curry being terminated as Head Coach and Campus Athletic Coordinator.

The community became outraged over the termination as the District blatantly disregarded Coach Curry’s due process rights and even violated the First Amendment rights of his attorney, Joey McCutchen.

I detailed the events in a series of articles and have attached the links to them at the end of this article.

This morning started a new chapter in Coach Curry’s struggle.

A lawsuit was filed this morning in Sebastian County Circuit Court, by McCutchen, on behalf of Curry, against the FSSD, School Board and Superintendent Morawski.

It alleges Morawski illegally removed Curry from his positions of Head Coach and Campus Athletic Coordinator and reassigned him to the Student Detention Center.

Among other requests, the lawsuit also asks that the Court order that Curry be reinstated to the Head Coach and Campus Athletic Coordinator positions stating –

“WHEREFORE, Plaintiff requests that this Court enter a judgment declaring that his reassignment was unlawful and void, that the contract provision granting the Superintendent reassignment authority is invalid and unenforceable, and that any similar language in employment contracts throughout the District is likewise invalid and unenforceable. Plaintiff further requests injunctive relief prohibiting the Superintendent from making reassignments without Board approval and an order reinstating him as Head Football Coach at Northside High School for the remainder of his contract term.”

Coach Curry stated – “If the reason for my reassignment is, in fact, wins and losses as some have speculated, then that policy needs be applied districtwide for all coaches. Further, if performance on the field is the standard, then the same merit-based standard needs be applied to coaches. Otherwise, the district is unfairly and unjustly singling out me.”

McCutchen followed with – “Coach Curry has tried to resolve this unlawful action by Superintendent Morawski without the necessity of filing a lawsuit but the district has sidestepped substantive review at every step. Further, Superintendent Morawski or board members have never given Coach Curry even one reason for the abrupt reassignment.”

The lawsuit comes as the Board is poised to hire a new Northside Head Football Coach at a Special Called Board meeting tonight at 5:30pm.

Sources within the District confirm that Dominic Mirocke has been chosen to replace Curry.

Mirocke is the former Assistant Head Coach and Offensive Coordinator at Arkansas Tech University. He met with the Assistant Coaches at Northside yesterday afternoon.

You have to wonder, with the lawsuit having been filed, if that will give the Board pause on approving the hire of Mirocke ?

From Mirocke’s perspective, will it give him pause on accepting a job from which a Judge may very likely order him to be removed ?

One thing is for sure ….Morawaski and the Board have created one Hell of a mess at the District….But then again what’s new there ?
